The dubbing of copyrighted material is illegal, plain and simple.
According to the present law, it is legal to dub a (one) copy for
yourself. Recording multiple copies of a single movie or television
episode/series is ILLEGAL. Even dubbing a series for someone in a trade is
illegal. You've seen what is going on with NAPSTER and it is the
same, if not worse, with television and feature films. (particularly with
features still at the box office.)
Titles 505 & 506 that everyone
refers to is for criminal charges only. Not the legality of recording copyrighted material.
If you think or believe otherwise, you are WRONG. People will show you where
trading is legal is some documents. It also is known that if the FBI or a
studio wants
to, they can make an example out of you. And it will be costly. To
help yourself out, NeVeR trade or sell multiple copies of one title to
anyone. Possibly two max. And... never, ever trade or sell copies of
new releases at the box office.
You can be fined/charged up to
$100,000 for each video you are busted for illegally dubbing and selling/trading. They can
confiscate your entire video collection along with VHS players, computers,
TVs etc. And you
will NOT get them back if convicted.
Dubbing from one tape to another
is
illegal. Unless of
course you own the copyrights. This does not include dubbing a single
copy for your collection.
Trading dubbed tapes is
illegal,
essentially. Generally though a
person just trading for their their collection will not be messed with.
No promises.
Purchasing a dubbed tape
or copyrighted material is
NOT illegal at this time.
Selling dubbed tapes to pay for your time, wear and tear,
vhs replacement and so forth IS
Illegal. Selling for profit falls under the illegal
part, in case you were wondering. Generally trading tape for tape will
not be messed with. The Anti-Piracy company is after people selling
multiple copies of new releases or material in bulk. It would cost
them a lot of money to take some poor trader to court. For them it isn't
worth it.
Dubbing of unreleased shows/movies/episodes, television
series, television movies, work prints or whatever
IS also Illegal. It is still copyrighted material whether unavailable or
out of print.
Selling, trading or
giving away video labels or cases with photos or likeness
drawings of characters from a show IS Illegal. I decided to ask on this
one too. You are still making a profit off someone else's copyrighted material.
The information contained on
dubbing videos does not give you or anyone else permission to do something illegal.
Stupidity of the law is no excuse and will NOT be accepted when you go to
court. The
information within this area is nothing more than information to inform you how to dub videos the proper way, for
personal consumption.
SPECIAL NOTES TO
TRADERS:
1. If you are trading videos on the internet, do NOT
put up a website with your collection of videos posted.
Just email the listings back and forth to each other. Don't even post the list on the
internet. Not worth what might happen to you. Putting up a website is a first sign indicator to the
Anti-piracy division of Hollywood that you are running an illegal business, selling
copyrighted material. Always protect yourself and those you trade with.
Believe me, they are watching.
2. Trading will
degrade and ruin your tapes. The more they are played the tape stretches
and takes abuse. To protect your collection, dub yourself a second set for
your personal collection and use your masters to dub from.
